Winding Up an Estate with House of Heirs

Winding up an estate can be overwhelming, emotional, and complex. At House of Heirs, our dedicated team of in-house estate specialists across South Africa ensures that your family navigates this process with care, clarity, and efficiency.

Step 1 – Notify House of Heirs

Let us know of your loved one’s passing. A dedicated Estate Consultant is assigned to guide your family from day one.

Step 2 – Schedule an Appointment

🗓 We visit your home or meet at our regional office to start the process and any answer questions you have.

Step 3 – Family Consultation

📝 Gather documents if not already in our online vault, signatures, and all necessary information—smoothly and efficiently.

Step 4 – Transfer to Administrator

⚖ We open the estate file and submit the application for Letters of Executorship (LOE) to the Master of the High Court.

Step 5 – Letters of Executorship

📄 The Master reviews all reporting documents and issues the LOE, giving us authority to administer the estate. We then also make contact with the relevant institutions to gather information about all assets in the deceased name. This information is important in order to proceed to the next step of preparing the Liquidation and Distribution Account.

Step 6 – Draft Liquidation & Distribution Account (L&D Account).

A section 29 advert is placed in the newspaper and government gazette whereby creditors have a period of 30 days within which to contact our offices and inform us of any claims.
📊 We prepare the Liquidation & Distribution Account and meet with heirs and beneficiaries to explain this in detail and answer any questions should you have any.

Step 7 – Master’s Review

🔍 L&D is submitted to the Master for approval, ensuring full legal compliance.

Step 8 – Advertise & Lodge L&D

📰 Section 35 advertisement is placed in the newspaper and government gazette, the L&D account is also lodged at the relevant Magistrate’s Court for public inspection and has to lie open for inspection for a period of 21 days.

Step 9 – Settle & Distribute

💰 Taxes paid, creditors settled, transfer of assets like property and vehciles and heirs receive their inheritance.

Step 10 – Close the Estate

🏁 Filing Slip issued by the Master allows us to formally close the estate. Your family can now rest easy.
